Terms & Conditions and Private Policy
1.The Photography Business accepts that from time to time there is a need to cancel or postpone scheduled shoots. The following cancellation and postponement fees will apply;
•Cancellation with more than 48 hours notice – all expenses incurred up to that time and 15% of quoted amount.
•Cancellation with less than 48 hours notice – all expenses incurred up to that time and 25% of quoted amount.
•Postponement on the day due to weather or issues that cannot be avoided will incur a fee of 25% of operating costs.
•Postponements on site, or within 2 hours of agreed time, due to weather or issues that cannot be avoided will incur a fee of 30% of operating costs.
2.Any works above and beyond the agreed project brief, as indicated in the quote, may incur additional fees. This is at the discretion of The Photography Business and will be communicated before undertaking any works.
3.Projects located outside a 50km radius of the Sydney CBD may incur additional fees for travel time and associated costs. The Photography Business will advise prior to undertaking any works if this is the case.
4.All fees are GST inclusive. The Photography Business requires 50% deposit prior commencing the shoot and 50% balance within 14 days of product delivery.
5. 50% Deposit payments must be paid prior to the shoot to secure your booking. The 50% balance payments are to be paid in accordance with our 14 day terms. Late payment will incur an interest accrual of 1.5% for each month thereafter. Should any further action be required, after our 14 day terms, to recoup payment any and all costs will be added to the outstanding amount and passed onto the client.
6.The Photography Business retains ownership of all intellectual property and other rights for any materials produced or created by us during the provision of the services. The Photography Business will grant you an irrevocable, royalty free license to use those materials in all media throughout the world for promotional purposes only and only for the agreed upon project. Use of images or video outside of the agreed project is subject to additional fees.
7.Whilst The Photography Business take’s all reasonable steps to deliver your order within the agreed terms, our liability for any loss or damage incurred by you as a result of your order not being fulfilled shall be limited to the cost of the specific individual products or services.
8.You agree to inspect all services rendered and notify us of any amendments within 5 business days, failing which we will have no liability for any errors.
9.Standard Delivery: Your order will be complete by close of business on the agreed day of delivery. The Photography Business shall retain full ownership of intellectual property and other rights of all materials until such time as full payment has been received. After payment The Photography Business still retains the rights as indicated in point 6.
10.The Photography Business will store images and materials provided for a maximum of 3 months. The Photography Business provides no guarantee that delivered materials will still be available after the 3 months term. Re-delivery of materials after this time will incur an administration fee of $35.
11.Nothing in this agreement limits any right or remedy you may have under applicable legislation, which may include the Consumer and Consumer Act 2010 (Cth) and/or similar state or territory legislation which contains provisions to protect the purchases of goods and services in certain circumstances.
12. Refund Policy, the photography business refunds the deposit invoice as per section 1. Cancelation, once the job is in progress and delivered we do not offer refunds.
We use your Personal Information only for providing and improving our service. By using our services, you agree to the collection and use of information in accordance with this policy.
Information Collection And Use
While using our services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name (“Personal Information”).
Like many site operators, we collect information that your browser sends whenever you visit our Site and third party partners such as XERO and EWAY. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze information.
We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information.
Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive.
Like many sites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.
